April BRT Update
Hi All,
By now you have likely heard the news that the Buc-ee's related company, Buc-ee's EPCO LLC purchased the land on the west side of I-25. While this may seem like a setback, this was the expected next step after the BLA administrative approval.
We always knew that defeating a billion-dollar company like Buc-ee’s would be a challenge. However, had we not fought alongside the prowess of Integrity Matters, the building would already be there and in operation right now. Other communities have defeated the Beaver, and Buc-ee’s has sold land they purchased in anticipation of building. This is not the time to lose heart or to give up!
Despite what the opposition wants you to believe and despite that EPCO and other agencies keep parroting that “there has been no application filed yet” do not be fooled - this is NOT a done deal. While Buc-ee’s is working in the background to pave their way forward, likely in the hopes of an administrative approval, this side has been working diligently too:
The CRCP 106(a)(4) and TRO filed by Integrity Matters is still pending judicial review
Multiple citizens on wells have filed for hearing with DWR
Actions are being taken to preserve and protect well water rights
Even with its two well permits, Buc-ee’s needs at least 30% more water
CDOT has not approved Buc-ee’s traffic plan
EPCO has not approved rezoning
The pro-Buc-ee’s group is waging a psychological war to normalize the idea that the people can’t change this outcome, but local governance still matters and there are still significant issues surrounding water and infrastructure that are unresolved. With the pending water supply issues, they can go back to Palmer Lake (who is still pending a formal acceptance of Buc-ee’s withdrawal and whose meetings are still being heavily attended/influenced by the pro-Buc-ee’s cohort).
While EPCO may be “waiting for a formal application” you can take action today. Reengage your public officials: Governor Polis and Senators Bennet and Hickenlooper stood up against this once - they have the power to do it again. Voice your concerns about the process, water rights, and safety, and demand accountability, integrity, and respect of the rights of the local homeowner - not just the new developer.
Volunteer groups have been formed - if you can volunteer, please reach out. Regardless, keep fighting - if we don’t *then* we certainly won’t win.
